Sahara to SEBI: Expedite investor verification, ads won't help


Hitting back at Sebi, embattled Sahara group today said issuance of advertisements would not help the regulator reach out to the investors spread across remote parts of the country and offered its help in verifying 95 per cent bondholders it claims to have already refunded. 


"The proof of the pudding is in eating. Sahara is confident that verification will prove not only the existence of the investors but also Sahara will get all its money which is with Sebi," the group said in a statement.

This follows comments made by Sebi's Whole-Time Member S Raman yesterday on the sidelines of a conference in Mumbai, where he wondered why not many claimants were coming forward to get back the money in the high-profile Sahara case.

"As far as Sahara is concerned, we have a decent amount of money but not many claimants. That is a question mark, as to why there are no claimants despite the fact that we have made multiple advertisements seeking applications to pay the money," he had said.

Terming his comments as "misguiding and irresponsible", Sahara accused Sebi of indulging in 'media trial' on Sahara- Sebi matter when the case was 'sub-judice'.

It said the regulator was not finding many claimants because "Sebi
 in four years has not initiated on-ground verification of the investors".

The group further said that Sebi has issued four newspaper advertisements directed towards only those investors who have yet to get refund. But, "the majority 95 per cent who have already got back their money are neither addressed in these advertisements nor will they anyway, bother to reply to Sebi (even if asked) as they have already got their money refunded from Sahara."

"Besides, it is imperative to understand that almost entire majority of Sahara investors (including the remaining 5 per cent investors) reside in the remote parts of rural India and are mostly illiterate or barely literate.

"Many of them live in mud houses, hutments and even slums, where there are no street names or house numbers (as there are no municipalities in small villages to allot house numbers, etc). Therefore, instead of merely issuing advertisements, a more serious and detailed approach should be adopted by Sebi to reach out to our investors," it said.

The group further said "Sahara with its more than 12 lakh workers has an unparalleled reach to investors".

Citing the Supreme Court order that Sebi can take help of Sahara for verification of investors, the group said, "It is not possible to reach out to these small investors and Sahara is always ready to assist Sebi in reaching out to the aforesaid investors."

Sahara is engaged in a long-running dispute with the Sebi over schemes involving raising of funds from public through certain bonds and the group was asked to return thousands of crores along with interest to the investors through the regulator.

"The entire desire of ours is to distribute as much money as possible," Raman had said.

Reacting to Raman's comments about Sahara giving truckloads of documents not connected to one another and the regulator undertaking the gargantuan task of sifting through those, Sahara said the group was asked to send all the document pertaining to 3 crore investors to Sebi
 in 10 days.

"The OFCD (bonds through which money was raised) was not closed and in fact in process of refund to a large number of investors was on. In this scenario many of the document were at our head office while a big number of documents were at our more than 4,000 branches.

"Keeping in mind the time limit of 10 days, we collected all the original documents as it is from all our offices across India and had sent the same to Sebi is boxes through 127 trucks," Sahara said in a detailed statement.

Stating that there was no fault on Sahara's part, it further said, "The documents of 3 crore investors cannot be handful and quite understandably will be huge in number because it contains the proofs of repayments of three crore investors - original repayment vouchers, receipts, KYC and other relevant documents.”

"Further, Sahara had in fact offered Sebi to help in the collation of documents and stationed its 50 officials in Sebi's Mumbai office to assist the market regulator. We were even ready to increase the number of officials to many hundred, but Sebi has refused to take their help. "Moreover, Sebi refused to take around 25 per cent of the documents which are still lying in our warehouses in Mumbai," it added.

It further accused Sebi of not having made "any serious effort" to start the verification even after two years of having claimed to have successfully organized the documents.

It further asserted that verification of "documented proofs" provided by Sahara would prove that all its "investors actually exist".

The group said the amount deposited so far with Sebi is more than Rs 14,000 crore, including interest earned, and recently it has given additional Rs 500 crore, though Sebi has refunded only Rs 55 crore.

The last rites of Reverend Smt. Chhabi Roy, mother of Saharasri Subrata Roy Sahara, has been performed yesterday dated 7th May 2016, in Baikunth Dham, Lucknow.
The last journey of Reverend Smt. Chhabi Roy has been attended by more than 50,000 people, including the family members of Sahara India Pariwar and the well wishers, including Shri Akhilesh Yadav - Hon'ble Chief Minister, Uttar Pradesh, Shri Shivpal Singh Yadav - Cabinet Minister, Uttar Pradesh, Shri Amitabh Bachchan, Shri Abhishek Bachchan, Shri Raj Babbar and his wife Smt. Nadira Babbar, Yoga guru Shri Bikram Choudhury, hockey Olympian Shri Dhanraj Pillai and many more. Shri Amitabh Bachchan and Saharsri Subrata Toy Sahara spent a considerable amount of time together in Sahara Shaher at Gomti Nagar, Lucknow.
At 4:30 PM, the funeral procession started for Baikuntha Dham. The open truck carrying Rev. Smt. Chhabi Roy was swarmed by the family members of Sahara India Pariwar. Wading through the crowd, Hon'ble Chief Minister of UP, Shri Akhilesh Yadav stopped near the gates to offer floral tributes. The procession turned into padyatra to reach its destination st 5:45 PM. Moments before sunset, Saharasri performed the mukhagnee ritual.

Subrata Roy’s success at being positive

When it comes to naming multi-faceted personalities, there are many who would say that Subrata Roy is a name that pops up in their mind almost instantly. It’s an unconventional choice but it is also a choice with merits because Subrata Roy is a man that has built a multi-billion dollar empire through sheer hard work, resilience and dedication. Not because she was my mother but all the human being who knew her will definitely say that she had tons and tons of affection for others which is not commonly seen.

It is her influence that we brothers and sisters understood the world with absolutely positive mind.

It is her teaching that ingrained in me to always remain positive minded for others and in all circumstances be positive yourself.

She used to always say that learn and practice to see positive aspect of all human being.

I never feel tension and it is my mother's teaching and influence.

Every day her phone calls were on an average used to be 40-50.

Her contact circle was huge.  She knew distressed people amongst relatives, amongst Sahara India Pariwar people (who she used to meet) and she will make it a point to help those distressed people.

On her command we used to help such relatives whom we never knew.

I enjoy in giving others.  She cultivated this wonderful and very enjoyable characteristic that giving is in my hand and expectation of getting depends on others.  So she taught to adopt the giving characteristics since that is in our hand.

She was most affectionate mother, teacher, philosopher etc.etc. but she was very difficult in the matter of girl friend.  That fundamentalism was there that you can be friend or touch any girl who you shall marry.

 But she was a mother beyond definition and I pray God that everybody get mother like her then I can confidently say that every sons and daughter will grow most positive minded with gratitude character and the strong desire to help others.  What a wonderful world it will be.

With a deep pain and anguish, We are to inform that mother of 'Saharasri' Subrata Roy Sahara and the guiding light of our Sahara India Pariwar, Rev. Smt. Chhabi Roy, departed for her heavenly abode today i.e. 6th May,  2016 at 1:34 a.m. in the night. Smt Chhabi Roy wife of Late Shri Sudhir Chandra Roy was 95 year old. She was born on 15th of January in Araria district of Bihar. She has been critically ailing with for last more than 2 years and was at a makeshift hospital at Sahara Shaher, Lucknow.

Senior counsel of Sahara, Mr. Kapil Sibal has submitted that since the worth of Sahara’s 86 properties whose original documents are with SEBI for long, is of worth of more than Rs. 40,000 crores and is more than Rs. 5,000 crores of the required Bank Guarantee. The SEBI to get the properties valued and if the admitted valuation is more than Rs. 5000 crore and was contended by Sahara that it should be treated as security and Mr. Subrata Roy Sahara and two Sahara directors be released. To this Hon’ble Court has directed SEBI to work on this proposition

Criticise nation but logically

The Subrata Roy case: What’s happening to the billionaire who couldn’t get away?

The nationwide bust up over how a certain liquor baron made bankers kiss dirt, walking away with bagful of cash through a VIP channel, possibly to an undisclosed city in Europe, is making headlines and triggering breaking news almost every day now.
But questions need to be raised about the curious case of billionaire Subrata Roy who paid loads of cash to the market regulator and last week completed two years behind bars in Delhi's maximum security prison.
Roy, who recently wrote a tome on his life experiences, is now called a philosophical author by many .
Jokes apart, someone seriously needs to scrutinise the case again, especially at the way the Securities and Exchange Board of India (SEBI) handled it and the way Sahara group demonstrated considerable resilience. A few days ago, a handful of Sahara employees protested the delay in payment of salaries; they were in their undergarments. The idea was to be visible  on television.
But what's happening in the case?
On 31 August, 2012, the apex court had asked SEBI to return money to Sahara's investors. In the last 40 months, it has been able to pay Rs 50 crores. The Mumbai-based market regulator advertised four times in as many as 144 newspapers, inviting demands for repayment. Worse, the fourth advertisement said it was the last opportunity for raising demand for repayment.
Does that mean that - under any circumstances - SEBI won't be able to pay over Rs 100 crores? And what has it got in its kitty? It has received a whopping Rs 12,000 crores and even earned interests on FDs. Also, SEBI has the property papers of Sahara's land bank worth Rs 40,000 crore in its custody. There are chances it will have another Rs 5,800 crore ( Rs 800 crore cash and Rs 5,000 crore bank guarantee) by the time Roy and his two directors walk out of the prison gates. Sahara, which sought time for raising the stipulated cash from its assets for SEBI, was given a 45-day extension that ended in November 2015. The group claimed it had five "solid offers" for its properties.
The slugfest between the market regulator and Sahara has been described as corporate India's best known samudra manthan. SEBI disputes Sahara's claim that it has paid 95 per cent of its investors from whom it had collected Rs 24,000 crores through optionally fully convertible debentures (OFCD) in 2009-10, after the written permission from 2 Registrars of Companies. The Supreme Court however, upheld SEBI's plea and directed that Saharas' investors have to be refunded the money along with interest through SEBI.
The billion dollar question that needs to be raised is when will SEBI verify the authenticity of these investors? If four advertisements have failed, doesn't it become obligatory for SEBI to verify Sahara's repayment claim? After all, the Supreme Court says the the final decision on the issue of unpaid investors lies with SEBI. The market regulator, which said in January 2013 that it wanted to hire a verification agency, has reportedly failed to organise one. So who will help ascertain the genuineness of bondholders in the Sahara case.
Look at the way the events have progressed. SEBI has not given any reason for withholding its notice inviting the tenders. The first tender to seek a verification agency was floated on 2 November, 2012. SEBI asking for applications by 22 November, 2012. It did not happen and so the deadline was extended to 21 December, 2012, and again extended till 15 January, 2013. After the expiry of this last deadline, SEBI decided to withhold the tender notice.

It is now March 2016. Someone must ask questions, either in court or on televised debates. Otherwise, the billionaire, will have no option but to write the second sequel of his planned trilogy.

The name Subrata Roy triggers really passionate responses and reactions in people. It doesn’t matter whether you think that the man is a modern day prophet or the greatest impostor on Earth, your reaction is going to be passionate. A recent alarming trend that I have observed is the propensity of the public to disregard any previous achievements of a person and also declaring a person guilty or not (based on media reports) before the court has decided on a final verdict. It is especially appalling if the person in question has not had a chance to put his perspective across. This book launch is Subrata Roy’s chance of putting his perspective out in the public. And it should be respected just like you would respect any other citizen’s right to voice his/her opinions.
